As of today, (Wednesday January 26, 2022), The Occupational Safety and Health
Administration (OSHA) has officially withdrawn its Emergency Temporary Standard and stopped requiring/enforcing large employers with 100 or more employees to vaccinate or test weekly.
Per court documents, OSHA will withdraw the ETS and continue to work closely with the Biden administration to create a more permanent standard based on the Supreme Court’s ruling. OSHA must also wait to see how it plays out in the lower courts as the other contested portions work their way through the court systems and possibly back to the SCOTUS.
In a nut shell:
- It’s a big win for large companies not wanting to force a “vax or test” situation
OSHA will officially withdraw its ETS - OSHA and the Biden administration are still working hand in hand to develop a more
permanent vaccine standard. - It’s possible the SCOTUS will weigh in again on the constitutionality of similar court
challenges.
