PHMSA Publishes Final Rule Using the APA

Express Lane Final Rule

The U.S. Department of Transportation (DOT) Pipeline and Hazardous Materials Safety Administration (PHMSA) recently published a Final Rule (May 11, 2022) without notice or public comment under the Administrative Procedures Act (APA).  Under the APA, “Matter[s] relating to agency management or personnel” do not require the same procedures required under its normal rulemaking process.

Effective May 11, 2022 PHMSA has adopted new language that clarifies previously dated language to explicitly allow inspectors to directly refer “actual or possible criminal activity to OIG (Office of Inspector General) through its hotline accessible by telephone, email, physical mail, or the OIG’s website.”
