      FMCSA: 4 New Crash Types for the CPDP

      In a recent Notice and Request for Comment published in the Federal Register by the Federal Motor Carrier Safety Administration (FMCSA), the FMCSA seeks to add 4 new crash types to its current Crash Preventability Determination Program (CPDP) within the Agency’s Safety Measurement System (SMS). For those unaware what the CPDP is, it is a program within the FMCSA that currently looks at 16 different types of commercial motor vehicle (CMV) crashes that could be deemed “not preventable” thus taking blame off a company’s driver.

      Under the new guidelines, the FMCSA would utilize both police accident reports (PARs) along with other supporting documents, more specifically video evidence to help make its determinations. Listed below are the 4 new crash types the FMCSA looks to add to its current lineup:

      1. CMV was struck on the side by a motorist operating in the same direction. Currently, the crash type is limited to side strikes at the very rear of the vehicle (e.g., 5:00 and 7:00 points of impact).
      2. CMV was struck because another motorist was entering the roadway from a private driveway or parking lot.
      3. CMV was struck because another motorist lost control of their vehicle. FMCSA reviewed many PARs that included this information but were ineligible for the program under the current crash types.
      4. Any other type of crash involving a CMV where a video demonstrates the sequence of events of the crash.

      Furthermore, the FMCSA looks to amend and broaden the some of the current crash types to allow more crashes to be eligible for determination. To submit your comment you can go to the Federal eRulemaking Portal, but make sure to submit it before June 12, 2023 as all comments must be received prior to that date.
