      Are You Ready?

      Have you heard the saying “Everything is bigger in Texas?” Apparently, the Texas Commission on Environmental Quality (TCEQ) has. On September 24, 2020, TCEQ announced the Fifth Revision of the Commission’s Penalty Policy which provides an outline for how they (TCEQ) calculates fines and penalties which violate the State’s environmental and hazardous materials waste regulations.

      This proposed change would create four major changes in the Penalty Policy:

      • It would increase the base penalty amounts for certain violations
      • It would increase enhancements for certain air emission events
      • It would remove some incentives for “early settlers” for certain penalties
      • It would increase categories for continual violations

      While the above does not cover every change listed in the Memorandum, a full review can be had by reading the 30 page TEQ Interoffice Memorandum.

      For those effected by these proposed changes, make sure to submit your comments to the TCEQ by October 31, 2020 as they are accepting public comments until then.
