      Incoming Civil Penalties Increase

      Inflation Is Not the Only Thing Rising

      They say there are only two guarantees in life, death and taxes. I feel like the Department of Transportation (DOT) feels left out, which is why they increase the civil penalties each year. All joking aside, we all knew this year was going to bring some major increases with inflation running ramped.

      With that said, effective March 21, 2022, we saw some major increase including:

      1. 49 U.S.C. 5123(a)(1) – “Maximum penalty for violation of hazardous materials transportation law relating to training,” saw a 6.22% increase or a $5,253 increase from last year
      • 49 U.S.C. 5123(a)(3)- “violation of hazardous materials transportation law,” also saw a 6.22% increase or a $5,253 increase from last year
      • 49 U.S.C. 5123(a)(2)– “violations of hazardous materials transportation law resulting in death, serious illness, severe injury, or substantial property destruction,” saw a 6.22% increase or a $12,257 increase from last year.
      • 49 U.S.C. 5123(a)(3)- “Minimum penalty for violation of hazardous materials transportation law relating to training (49 CFR 172.704),” saw a 6.30% increase or $32 increase from last year
