The Federal Motor Carrier Safety Administration (FMCSA) has opened Docket Number FMCSA-2018-0165 for comments until January 30, 2019. You, like many others may be asking yourself what is this proposed rule (RIN 2126-AC01)? The short answer is, it pertains to amending the Hazardous Materials Safety Permits regulations to incorporate by reference the updated Commercial Vehicle Safety Alliance (CVSA) handbook (2018). More specifically the Out-of-Service Criteria. Although this criterion is not regulation, it does provide enforcement personnel nationwide, including FMCSA’s State partners, uniform tolerances for roadside inspections. Now back to the NPRM. In total, there are 15 updates that distinguish the 2018 version from the 2016 (6 updates) and 2017(9 updates) versions. Remember this is just a Notice of Proposed Rule Making and not a final rule.  To submit comments, you have until January 30, 2019. To submit comments, you may use the following methods:
