PHMSA NPRM: Real-Time Hazardous Materials Information

In case you missed it, On June 27, 2023 the Department of Transportation (DOT) Pipeline and Hazardous Materials Safety Administration (PHMSA) announced a Notice of Propose Rulemaking (NPRM) aimed at keeping first responders safer and improving public safety and reducing environmental impact, In accordance with the National Transport Safety Board’s Fixing America’s Surface Transportation Act, this new rule would go beyond class 1 railroads and extend requirements to all railroad classes.
PHMSA is looking to amend its regulations to “require a proactive notification to local first responders in the case of an accident or incident involving a release or suspected release of hazardous materials.” It would also require all railroads to generate in electronic form, maintain, and provide in real-time accurate, electronic information about rail hazmat shipments. It is the hope of PHMSA that this will help first responders have a better understanding of what they will be dealing with prior to arriving on scene.
