New Year, New Penalty Amounts
The Department of Transportation (DOT) and it many agencies have increased the maximum civil penalty amounts for various hazardous materials shipping and transportation regulation violations for fiscal year 2025. For now, we will highlight some of the more common violations below:
- DOT Hazardous Materials Violation 49 U.S.C. 5123
- Received a 2.56% increase to $102,348 (+$2,592)
- DOT Hazardous Materials Violation resulting in death, serious illness, severe injury, or substantial property damage 49 U.S.C. 5123
- Received a 2.56% increase to $238,809 (+$6,047)
- DOT Hazardous Materials Training Violation 49 U.S.C. 5123
- Received a 2.56% increase to $617 (+$16)
Of the many violations from the various agencies, one of the easiest avoidable penalties that can become quite costly is the failure to provide hazmat training for employees. This violation can add up quickly as it applies to each employee on a per day basis with a maximum amount of $102,348.
