Exemption Vacated!

On November 8, 2021, the Environmental Protection Agency (EPA) published its Final Rule revision to the original 2018 rule “Reporting Requirements for TSCA (Toxic Substances Control Act) Mercury Inventory: Mercury.”

You may be asking yourself what does this exactly mean? Well, let’s go over the timetable of important dates to get caught up.

• June 2018–  EPA finalizes its Reporting Requirements rule
• July 2018 – The original rule was challenged in the 2^nd Circuit Court of Appeals
• November 2019– Oral arguments are held
• June 2020– The courts chose to vacate the exception for pre-assembled products containing a mercury added component.
• November 2021– EPA finalizes their revision
• December 8, 2021– The rule goes into effect
