EPA: Final Rule Alert

SNUR
On June 13, 2025, the Environmental Protection Agency (EPA) published its final rule issuing its significant new use rules (SNUR) under the Toxic Substances Control Act (TSCA). Specifically, the new SNUR applies to certain chemical substances that were subject to pre-manufacture notices (PMNs) along with Orders issued by the EPA pursuant to TSCA. What the new SNUR requires is those who manufacture or process chemicals listed in the new SNUR to notify the EPA 90 days before commencing the manufacturing or processing of said chemical substances. In doing so, it initiates the EPA’s evaluation of the use of that chemical substance. It should also be noted that manufacturing or processing may not commence until the EPA has conducted its review, made determinations, and said determinations carried out.
This final rule has an effective date of August 12, 2025, and a judicial review date of June 27, 2025, at 1 p.m. EST.
