Used Drum Management and Reconditioning

On August 11, 2023, the Environmental Protection Agency (EPA) submitted an Advanced Notice of Proposed Rulemaking (ANPRM) to seek public comment and information to assist in:

 “Potential development of non-regulatory and regulatory options that would ensure the proper management of used industrial containers that held hazardous chemicals or hazardous waste, up to and including the drum reconditioning process.”

The EPA is considering going as far as:

• Revising the Resource Conservation and Recovery Act (RCRA) regulations
• Other non-regulatory options
  • Compliance assistance
  • Increased inspections
  • Wastewater discharge/handling issues
  • Voluntary standards
  • Best Practices

It should be noted that the ANPRM does not change or propose and existing regulatory requirements and is simply seeking comments and information currently. As such, all comments must be received by September 25, 2023. If you are one of the following entities, you may want to pay particular attention to this ANPRM:

• Owners and operators of drum reconditioning facilities.
• Communities where these facilities or operations exist.
• Container transporters.
• Used drum generators.
• Chemicals manufacturers.
• Waste or hazardous waste generators, industrial facilities.
• Environmental action organizations.
