      Revisions to Civil Penalty Amounts

      New year, new penalty amount? There is an old colloquialism that says, “Only two things in life are certain: death and taxes.” Well, I am pretty sure we can add the increase to civil penalty amounts to that short list. In case you were not aware, every year the Department of Transportation (DOT) adjusts the penalty amount for violations for each of their departments to include: Office of the Secretary (OST), Federal Aviation Administration (FAA), National Highway Traffic Safety Administration (NHTSA), Federal Motor Carrier Safety Administration (FMCSA), Federal Railroad Administration (FRA), Pipeline and Hazardous Materials Safety Administration (PHMSA), Maritime Administration (MARAD), Great Lakes St. Lawrence Seaway Development Corporation (GLS).

      Effective December 28, 2023, all violations from that point on will be subject to the new 3.2% increase. Any violations occurring before December 28, 2023, will remain subject to the lower amount. Because increases are tied to inflation this year’s increase was lower that both previous years 2023 (8%) and 2022 (6%).
