PHMSA: Notification of Conforming Amendments

Hazardous Materials: Liquefied Natural Gas by Rail
For those of you who have been following Liquified Natural Gas (LNG) by Rail rule its been quite the journey thus far. Recently on June 23, 2025, the Department of Transportation (DOT) Pipeline and Hazardous Materials Administration (PHMSA) published a notice of confirming amendments which amends the Hazardous Materials Regulations in response to United States Court of Appeals for the District of Columbia Circuit in Sierra Club, et al. v. DOT, et al., No. 20-1317 (Jan. 17, 2025).
These amendments simply restore the text of the HMR to what it originally said prior to the effective date of the LNG by Rail Rule. The following sections will revert to the effective version prior to August 24, 2020. Those texts that did not exist prior to this effective date will be deleted. Those sections affected are listed below:
Reverting Back:
Being Deleted:
- § 174.200(d),
- 400-26, and
- 515(d)
It should be noted that these changes do not affect the transportation of LNG by highway, vessel, and rail by UN T75 portable tanks or those who seek special permit authorization in DOT 113C120W9 specification rail tank cars.
