      Keeping Compliant In The Hazmat Industry

      When you operate a business in the hazmat industry, compliance to regulations is essential. The failure to adhere to industry rules could lead to the demise of a business – so you’ll need to remain on top of the guidelines that regulate hazmat companies. The following points may be used as a general outline of information you’ll need to know to stay alive in the hazmat industry.

      DOT Training for Your Business

      Department of Transportation (DOT) training is a requirement for employers in the industry. Employers must also ensure that their workers understand the rules set forth by the Department of Transportation. If your employees perform any function that is regulated by US DOT Hazardous Materials Regulations (HMR), then you and your employees are required to know the regulations. This is why proper training is crucial for everyone involved.

      Required Courses

      There are several courses applicable to DOT regulations, and you will need to cover these with your employees. The required courses include information on hazardous material transportation, communication requirements regarding hazardous materials, emergency response requirements, and hazardous materials packaging.

      Hazardous Materials Carrier Responsibilities

      If your business involves carrying/transporting hazardous materials, be sure that everyone  is aware of the major responsibilities of carriers in the industry. These responsibilities include knowing how to determine hazardous materials, proper shipping names and classification, and identification numbers. You should also be informed on hazard warning labels, as well as the regulations for packing and marking hazardous materials. The topics of compatibility, shipping papers, and placarding will also be discussed.

      Other relevant topics to be covered in hazmat compliance training involve the training of employees, as well as proper certification. Emergency response information should be provided along with an emergency response number. You will also need to impart information to your employees on reporting incidents, and you should know how to devise and implement the right security plan.

      Preparing for a Compliance Audit

      Any company in the industry may be audited for hazmat and transportation compliance, so knowing how to prepare for such an event is vital. Your business may prepare for a compliance audit in a variety of ways. You should be prepared to provide documentation of proper liability coverage, in addition to documents that show that your drivers are licensed as they should be. You will also need to provide proof of DOT physical certifications. When you take DOT hazmat training, be sure to explore the other requirements involved with a DOT compliance audit – you will not want to undergo one of these audits without knowing all of the specific details and requirements.

      Enforcement and Penalties

      The Department of Transportation takes the enforcement of its regulations very seriously and businesses that are not compliant will be penalized. Businesses in the industry may be subject to testing, investigations, and hearings. The civil penalties for violating hazmat regulations may include steep financial fees for non-compliance, and the criminal penalties for willful violations may include steep financial penalties along with imprisonment.

      Compliance with DOT hazmat and transportation regulations is extremely important. Being properly trained is not just a way to stay alive in the industry. Training and certification could also ensure that you and your employees (and other involved parties) stay alive and well – and that you and your workers are able to perform your job duties.
