FMCSA NEDD. What Is It? And What Does It Mean For You?
Rules Out For Summer
Did you know most of the industries household goods moves during the summer months (May 1- Sep 30)? Probably not, but the Federal Motor Carrier Safety Administration (FMCSA) did. That is why they have chosen to move the date of enforcement to October 31 2022 for the revised provisions from the FMCSA Final Rule (Implementation of Household Goods Working Group Recommendation) which were meant to go into effect June 27, 2022.
On June 24, 2022, the FMCSA released a Notice of Enforcement Discretion Determination (NEDD) Concerning Certain Requirements For Household Goods Industry in 49 Code of Federal Regulations (CFR) Part 371 Subpart B and 375 [N0. 2022-006] to address the concerns of business owners in the household goods industry. While this notice does not “create individual rights of action and establishes no precedent for future determinations” according to the FMCSA, it does act as a safeguard for regulated groups from certain enforcement aspects.
