      2024 Notice Posting Penalty Adjustment

      They say knowledge is power. Which is why it is important for you to know your Rights as an employee without fear of retaliation. The Equal Employment Opportunity Commission (EEOC) recently published its final rule regarding the increase in penalty amount for failure to post the “Know Your Rights: Workplace Discrimination” poster. The previous amount for employers with 15 or more employees was $659. The new penalty amount applied to any infractions after February 16, 2024, is now $680 a $21 increase for each infraction.

      Under the law, employers with 15 or more employees are required to display the Know Your Rights poster which outline employees’ rights under the following anti-discrimination laws:

      • The Pregnant Works Fairness Act
      • The Americans with Disabilities Act
      • Title VII of the Civil Rights Act of 1964
      • The Genetic Information Non-Discrimination Act

      To avoid these penalties covered employers should ensure each poster is displayed prominently in common and easily accessible areas where everyone can see them such as. But not limited to:

      • Break rooms.
      • Common entryways.
      • Lunchrooms.
      • Any other common gathering area.

      Employers should also ensure each poster is up to date, easily identifiable, and legible. For those workers who are remote, employers should make electronic versions accessible to each employee as well and inform them of how and where to access such resources.
