      EPA: Proposed Rule

      Fuels Regulatory Streamlining Amendments

      Back on December 4, 2020, the Environmental Protection Agency (EPA) finalized the Fuels Regulatory Streamlining that replaced the previous gas, diesel, and other fuel quality programs in 40 CFR part 80 with a new set of provisions and definitions in 40 CFR part 1090. Since its finalization the EPA has found several provisions that require further corrections and clarifications within two main areas. This proposed rule looks to amend the following areas of concerns:

      1. Minor revisions to provide clarity and flexibility on several areas related to sampling and testing of fuel, fuel additives, and regulated blend stocks.
      • Technical amendments in Section III:
      1. Clarification of definitions and general provisions.
        1. Clarification of the truthful reporting requirement.
        1. Clarification of the RVP standard in federal 7.8 psi RVP areas.
        1. Adjustments to notifications under the National Fuel Survey Program (NFSP).
        1. Addition of provisions to allow for certifying fuel loaded onto domestic marine vessels.
        1. Numerous clarifications, corrections, and consistency edits to the regulations.

      It should be noted that this action does not propose change to the stringency of the existing fuel quality standards and does not open comment for any of the unchanged text. With that said, if you feel like you have input the EPA needs to hear about the fuels regulatory streamlining amendment, all comments must be received on or before October 15, 2024. If anyone contacts EPA requesting a public hearing by September 4, 2024, EPA will hold a virtual public hearing on September 12, 2024.
