What’s Going On With The ETS?
On January 7, 2022, the Supreme Court will hear arguments concerning the Emergency Temporary Standard (ETS) for Covid-19 testing and vaccination of employers with 100 or more employees.
On December 17, 2021, the 6th Circuit US Court of Appeals suspended the stay on the Occupational Safety and Health Administration’s (OSHA) ETS possibly making way for OSHA to enforce its proposed rules. OSHA however has stated it will not take enforcement actions on employers until at least January 10, 2022 and will not cite employers for the noncompliance in relation to testing until February 9, 2022.
So, stay tuned as January 7th is upon us and a final decision will hopefully be made soon on the future of the ETS.
