Federal Civil Penalties Inflation Adjustment Act Annual Adjustments for 2024
With the recent publication of the Department of Transportation’s (DOT) revision to civil penalty amounts, it should come as no surprise the Department of Labor (DOL) is following suit and raising civil penalty amounts in response to inflation. The final rule, which was published on January 11, 2024, will have an effective date of January 15, 2024. It should be noted, the new revised amounts will only apply to those penalties assessed after January 14, 2024.
Today, we will specifically be looking at the increase in OSHA amounts which can be viewed below.
- Willful violation, minimum §1903.15(d)(1)- $11,524
- Previous amount- $11,162
- Willful violation, maximum §1903.15(d)(1)- $161,323
- Previous amount- $156,259
- Repeated violation §1903.15(d)(2)- $161,323
- Previous amount- $156,259
- Serious violation §1903.15(d)(3)- $16,131
- Previous amount- $15,625
- Other-than-serious violation §1903.15(d)(4)- $16,131
- Previous amount- $15,625
- Failure to correct violation §1903.15(d)(5)- $16,131
- Previous amount- $15,625
- Posting requirement violation §1903.15(d)(6)- $16,131
- Previous amount- $15,625
