      Adoption of Miscellaneous Petitions and Updating Regulatory Requirements

      Recently the Department of Transportation (DOT) Pipeline and Hazardous Materials Safety Administration (PHMSA) released its final rule responding to 18 petitions for rulemaking covering such topics as address packaging, hazard communication, and the incorporation by reference of certain documents. It should be noted, PHMSA’s response to the regulated community are those submitted between May 2018 and October 2020. Important dates you should know about this final rule:

      • The effective date for this final rule is April 3, 2024
      • The Delayed compliance date is March 4, 2025.
      • Incorporation by reference date is April 3, 2024

      Below you will find some of the revisions to the HMR:

      1. Allow for appropriate flexibility of packaging options in the transportation of compressed natural gas in cylinders.
      2. Provide greater clarity on the filling requirements for certain cylinders used to transport hydrogen and hydrogen mixtures.
      3. Modify the definition of “liquid” to include the test for determining fluidity (penetrometer test) prescribed in the European Agreement concerning the International Carriage of Dangerous Goods by Road (ADR).
      4. Incorporate by reference the CGA publication CGA C–29–2019, “Standard for Design Requirements for Tube Trailers and Tube Modules, First Edition.”
      5. Facilitate international commerce, and streamline packaging and hazard communication requirements by harmonizing the HMR with international regulations to allow the shipment of de minimis amounts of poisonous materials.
