      UPDATE: OSHA’s Proposed Heat Injury and Illness Rule

      UPDATE 9/25/2025

       Proposed rule; extension of post-hearing comment period.

       We have an update to the update and will likely have another update to this update later. That’s a lot of updates! OHSA held its public hearing from June 16 through July 2, 2025, allowing stakeholders time to express comments. During the hearing, those who filed timely Notice of Intention to Appear (NOITA) for post-hearing has been extended an extra 30 days until October 30, 2025. This allows individuals and stakeholders extra time to gather and file evidence relevant to the proceedings. So, if you are one of those individuals or entities who filed a NOITA, you now have until October 30, 2025, to do so. To view the latest update in its entirety you can click HERE NOW.

       

      UPDATE 8/30/24

      As promised, as of August 30, 2024, OSHA published its Notice of Proposed Rulemaking (NPRM) requesting comments as it relates to the new proposed Heat Injury and Illness Prevention standard. Those affected by the new rule would be required to create a plan to evaluate and control heat hazards in their workplace. To view the proposed rule in its entirety you can click HERE NOW!

      You can also continue reading below to see the history of this rule and how far we have come. For those wanting to comment on the proposed rule, comments (including requests for a hearing) and other information must be submitted no later than December 30, 2024. It should also be noted, those parties interested in a informal public hearing must notify the agency of their intention to participate, and procedures for participants to submit their testimony and documentary evidence will be announced in the federal register.

      With summer heating up, you may recall in October of 2021 the Occupational Safety and Health Administration (OSHA) published an Advanced notice of proposed rulemaking (ANPRM) on the Heat injury and Illness Prevention in Outdoor and Indoor Work Settings. In the past, OSHA has relied on the General Duty Clause to protect workers from heat hazards. This new rule would give employees a greater level of protection. Although the specifics of the proposed rule are not available to the public at this time, after the Office of Information and Regulatory Affairs (OIRA) at the Office of Management and Budget (OMB) finish their review of said rule, it will be published in the Federal Register for all to read. The OMB received the proposed rule on June 11, 2024, and It typically takes 60 to 90 days for the OMB to review rules, so stay tuned for future updates on this major rule change.
