      DEA and HHS Second Temporary Extension of COVID-19 Exemptions

      Telemedicine Flexibilities

      We may all deal with different types of hazardous materials, but one thing all of us deal with is sickness and a need for medication. On March 1, 2023, the Drug Enforcement Administration (DEA), in cooperation with the Department of Health and Human Services (HHS), published two notice of proposed rulemaking (NPRM) soliciting comments to allow telemedicine practitioners to prescribe controlled medications to patients they have never conducted in-person medical evaluations of.

      On May 10, 2023, the DEA and HHS issued their first temporary rule extending certain exceptions granted to existing DEA regulations in March 2020 due to COVID-19 Public Health Emergency (COVID-19 PHE) until November 11, 2023. The second temporary rule was also extended to the end of next year, December 31, 2024, after consideration of the September 12 and 13, 2023 Telemedicine Listening Sessions.

       These rules help prevent lapses in care for those in need of schedule II-V controlled medication, including schedule III-V narcotic-controlled medications approved by the Food and Drug Administration (FDA). These extensions make it possible for many who would have no other safe means of obtaining their much-needed medications due to COVID risk or other health issues.
