      Phase-down of Hydrofluorocarbons

In a recent final rule published to the federal register, the Environmental Protection Agency (EPA) has removed regulations from the Code of Federal Regulations (CFR) as it relates to the prohibition of disposable cylinders and tracking of cylinders of hydrofluorocarbons. On June 20, 2023 the U.S. Court of appeals for the District of Columbia found that the AIM Act did not identify a provision of the AIM Act giving it authority to ban disposable cylinders or to require a QR-code tracking system, thus leading to the vacated portion of the Allocation Framework Rule.

In accordance with the Administrative Procedure Act (APA) the EPA made this rule effective September 11, 2024. If you are wondering if this action applies to you, it may be applicable if you are an importer, producer, exporter, destroy, or use as a feedstock or process agent, reclaim, or recycle HFCs. To view the final rule in its entirety and view some of the common North American Industry Classification System (NAICS) codes effected by this final rule, you can click HERE NOW.
